I. TERMS OF USE (EULA)

1. Legal Notice

The HearAround application is published by PEERLEDGE SARLAU, a Limited Liability Company with a Single Shareholder with a capital of 100,000 DH, registered with the Casablanca Trade Register under number 507811.

2. Object and Acceptance

These terms constitute a binding contract between the User and PEERLEDGE SARLAU.

3. Access and Age Requirements

• Access is reserved for users aged at least 8 years old.
• Minors: Users under 18 must obtain prior parental consent. Use by children under 13 must be supervised by an adult, especially when using Augmented Reality features on public roads.

4. Safety and Warnings (Gamification & AR)

The Application encourages movement in the real world.

• Vigilance: You must remain aware of your surroundings, obstacles, traffic, and third parties at all times.
• Safety Pop-up: You agree to read and validate the "Look around you" safety warnings displayed when activating AR.
• Liability: PEERLEDGE SARLAU disclaims all liability in the event of an accident, fall, or damage occurring during use on public roads or private property.

5. User License (EULA - Store Compliant)

PEERLEDGE SARLAU grants a personal, non-exclusive, non-transferable, and revocable license. PEERLEDGE SARLAU is solely responsible for the maintenance of the Application (not Apple/Google).

6. Intellectual Property

All elements (texts, graphics, software, tours, POIs, logos, sounds) are the exclusive property of PEERLEDGE SARLAU.

7. Warranties and Liability

The Application is provided "as is". PEERLEDGE SARLAU (and not Apple/Google) is responsible for addressing claims related to the Application (product liability, legal compliance, consumer protection).

8. Third-Party Beneficiaries

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms and have the right to enforce them.

9. Applicable Law

These terms are governed by Moroccan law. Exclusive jurisdiction is granted to the Commercial Court of Casablanca.

II. GENERAL TERMS OF SALE (CGV) - "ROUNDS"

1. "Rounds" (Virtual Tokens)

• Definition: Virtual value units used solely within the Application to unlock tours or gamification options.
• No Monetary Value: Rounds are not real currency, generate no interest, and cannot be exchanged for cash or transferred.
• Validity: Unused Rounds are permanently lost if the account is closed or banned.

2. Waiver of Right of Withdrawal

Pursuant to Moroccan Law 31-08 on consumer protection measures, the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium if performance has begun with the consumer's prior express consent. By purchasing "Rounds", you accept the immediate provision of content and expressly waive your right of withdrawal. No refunds will be issued.
